Health inquiries ruled out; asking Fla. judicial applicants about their fitness violates ADA, judge says

A federal judge in FL set nationwide precedent by ruling that four questions on an application for appointment as a judge violate the Americans With Disablities Act of 1990. The questions, similar to those on most states' applications for appointment to the bench, ask about a candidate's physical and mental health. The candidate who challenged the questions is being referred to as Pat Doe, gender unspecified, and is represented by James Green, president of the American Civil Liberties Union of FL.

Advances in reproductive technology have spawned a host of legal dilemmas attracting both challenging litigation and discussion among legal scholars. Post-mortem artificial insemination is among the rarest but most intriguing problems, while surrogate motherhood is relatively well established but continues to bring new challenges. Scholars agree that the law has not kept pace with the technology, but differ over whether a contract model or a family law model should prevail.
