Cleaning up Superfund law; controversy over liability provisions stalls reauthorization drive
Article Abstract:
Superfund liability issues have been controversial since their creation by the Comprehensive Environmental Response, Compensation and Liability Act of 1980but proposals to rewrite them before reauthorization are more modest than previously. The Superfund Cleanup Acceleration Act of 1997, Senate bill 8, has various liability-capping provisions and would have a 'fair share' allocation system at multiparty sites instead of joint and several liability. ABA interest in Superfund changes dates back to 1992, when a working group decided broad change was needed.

Article Abstract:
The ABA's opposition to legislation pending in Congress to restructure the 9th US Circuit Court of Appeals is discussed. The 9th Circuit is the largest of the 13 federal circuits, but despite this fact, the association cites the absence of compelling empirical evidence of dysfunction in the circuit's administration.

Article Abstract:
A report the Congress is considering is described, and it would seek information to determine how widespread racial profiling by police officers during traffic stops is. There is mounting statistical evidence and testimony from police officers that this problem exists.
