Article Abstract:
The 1998 case of First National Bank of Steeleville N.A. v. Erb Equipment Co. regards the various rights of senior and junior secured parties with respect to the disposition of collateral after default and belongs on every commercial lawyer's reading list. UCC 9-504 seems to require that a senior secured party wishing to control foreclosure must declare default and repossess the collateral before the junior secured party does so unless the former wants to loses its opportunity altogether.
