Court leaves cliffhangers for last
Article Abstract:
The US Supreme Court is leaving pronouncements on a number of politically and socially charged cases for the last weeks of its 1995 term. The 44 cases awaiting decisions concern the intersection of free speech and the prohibition on government support of religion, racially determined voting district shapes, mandatory drug testing, and affirmative action. The decisions may reveal more about the court's newer members, who appear to support trends against further limits on habeas review and for first amendment rights for commercial speech.

Bush's parting shot on habeas: asks for more restrictions
Article Abstract:
George Bush's main criminal justice goal was to limit the right to federal habeas corpus review, and on Election Day 1992 the Supreme Court heard arguments in Withrow v Williams, another habeas corpus case. The government asked the court to rule that alleged violations of Miranda rights and Fifth Amendment claims which had received 'full and fair' consideration at the state level would no longer have the right to federal habeas review. The court will issue a decision by the summer of 1993.

Back to the future; the justices re-examine the habeas corpus writ
Article Abstract:
The Supreme Court has thrown open the question of how far the right of habeas corpus extends for prisoners appealing state court convictions. In Wright v. West and Sawyer v. Whitley the court has invited briefs from all sides. The court has in recent years restricted the federal review of prisoners' appeals. The question posed in the Court's review of West is drawn from an amicus brief by Kent S. Scheidegger, who also inspired the Court in 1989 to limit habeas relief for state prisoners.
