Employment law; supervisor liability
Article Abstract:
The California Supreme Court ruled in Reno v. Baird that individual supervisors bear no personal liability under the California Fair Employment and Housing Act for unlawful discriminatory acts committed at work. This analysis of state discrimination law runs counter to a nationwide trend often making the individual perpetrator of illegal discrimination personally liable. The ruling does, however, leave open the possibility of supervisor liability for sexual harassment.

The employer's protectable interest lies at the core of a nonsolicitation clause, and the reasonableness of the restriction comes in second place, as the balancing of employee burden against employer needs. The New York Court of Appeals 1999 ruling on the matter, BDO Seidman v. Hirshberg as well as other rulings, are briefly described.

Article Abstract:
Spoliation-by-oversight, or inadequate document-retention policies in employment discrimination is discussed. Inconsistent federal laws on document-retention have complicated the issue.
