Courts OKs reach of INS abroad; to snag smugglers
Article Abstract:
The US Court of Appeals for the 9th Circuit has ruled in United States v. Chen that the INS can operate outside US boundaries. The factual situation before the court was nine alleged smugglers of Chinese illegal aliens and their attempted prosecution. The 9th Circuit reversed a district court dismissal of the case due to lack of US prosecutorial authority on the high seas. The court stated that Congress gives the attorney general and subordinates implied authority to enforce immigration laws, even when this means extraterritorial enforcement.

3-strike debate flares in Calif.; some 18,000 cases could be up for a rehearing
Article Abstract:
The Romero decision allowing some judicial discretion in spite of California's tough three-strikes law has fanned the flames of political controversy anew. Republicans and victims' rights advocates fear the court has destroyed the public's law-and-order wishes, while the criminal defense bar is minimizing the ruling's effect and suggesting there might even turn out to be a benefit. The advocates of the three-strikes law remain unfazed by the verdict and some 24 states have passed similar laws.

Calif. bar fires blanks on guns
Article Abstract:
Delegates to the California State Bar's 1993 convention who would have liked the association to vote on gun control were denied their wish by the US Supreme Court's 1990 decision in Keller v. State Bar. In this case, the court ruled bar associations cannot, in a state in which bar membership is mandatory, use dues to support political causes some members are opposed to. Advocating gun control under the rubric of preventing more crimes against lawyers does not work either.
