Courts start to rule on online harassment; cases weigh employer liability for employees' use of e-mail, chat rooms and porn sites
Article Abstract:
Issues regarding sexual harassment and discrimination law in a workplace with electronic communication are discussed. Plaintiffs can use e-mails affirmatively against their employer, but employers can protect themselves by instituting a preventive program, properly investigating claim and having an electronic communications policy.

Monitoring of employees still growing; employers seek greater productivity and avoidance of harassment liability; most workers have lost on privacy claims

Increased employer monitoring of employee performance is discussed. Studies state that two-thirds of employers engage in some kind of monitoring and technological innovations are giving them further options for doing so. Abusing e-mail and using Internet access to peruse pornographic web sites are examples.
