Death, habeas and good lawyers: balancing fairness and finality
Article Abstract:
The Rehnquist court is making the possibility of habeas corpus relief more remote and critics fear that this will make accused murderers' lives entirely dependent on court-appointed attorneys who tend to lack the expertise to do the job properly. An ABA study of capital cases between July 1976 and May 1991 found that 40% of the state trial court decisions were reversed by federal appellate courts due to constitutional violations. Another problem with court-appointed counsel is that fee-capping at low levels makes finding counsel difficult.

The Oakland fire's aftermath; lost homes and inadequate insurance keep lawyers busy
Article Abstract:
Lawyers have been kept busy by the aftermath of the Oakland, CA, firestorm in Oct 1991. They state that both Oakland and the water district were negligent and are attempting to resolve insurance disputes which have clients blaming insurance companies and agents for the inadequate homeowners insurance many of them held. Approximately 34 Oakland and Berkeley residents have submitted complaints to the California Department of Insurance.
