Debate still rages on torts: studies clash on the 'litigation explosion's' myths and realities
Article Abstract:
Dan Quayle's lawyer-bashing helped spur the legal community to investigate the allegations of a litigation explosion and Iowa University Law Professor Michael Saks, who has been researching the issue since the mid-1980s, doubts that this explosion ever occurred. University of Wisconsin Law Professor Marc Galanter favors a 'litigation index', a way of objectively measuring number of suits. The Association of Trial Lawyers of America has voiced its opposition to litigation explosion allegations and sponsored various projects to debunk advocates of the theory.
