Litigation; Y2K class actions
Article Abstract:
The purpose of the Y2K Act, which became law in July 1999, was giving some shield to corporate defendants against the great number of lawsuits which may arise from Y2K failures. The shield includes several litigation reforms, such as punitive damages caps, prelitigation notice requirements, proportionate liability limitations and special pleading prerequisites. Congress's grant of federal question jurisdiction to Y2K class actions should, however, be extended more generally to larger interstate class actions.

Complex litigation; dueling class actions
Article Abstract:
How much the Texas mini-multi-district litigation (MDL) rule will ameliorate some of the problems of duplicative class action suits remains unclear. In Oct 1997, the Texas Supreme Court added Texas Rule of Judicial Administration 11, which allows litigants in related cases to have these assigned to the same judge for pretrial matters. This and the fact that Texas cases must be remanded to the original court for trial is similar to federal MDL proceedings.

Article Abstract:
Some of the difficulties which have emerged since passage of the Private Securities Litigation Reform Act of 1995 are discussed. Suits have been filed to determine whether a group of unrelated investors whose only connection is their choice of counsel are qualified to serve as lead plaintiff. Criticisms of artificially created groups and of multiple law firms in this capacity are also covered.
