Defense bar angry over lab scandal; secrecy shrouds who's affected by the FBI lab's mishandling of evidence

Criminal defense attorneys are wondering if their clients might deserve new trials in the wake of reports about FBI mishandling of evidence. Many want answers from the US Department of Justice, which has refused to release the inspector general's draft report on the FBI's Washington, DC lab. Cases with evidence mishandled by the FBI are not exceptions to the statute of limitations.

A California medical malpractice lawyer named Mark O. Hiepler is profiled, who has used new theories for suits in his specialty as well as ways of getting around the limits on malpractice damages. These theories have included using the tort of wrongful interference with the doctor-patient realtionship to sue health maintenance organizations who wrongfully denied patients care.

Plans made by Steve Cooley, who became Los Angeles district attorney in 2000 with 63.7% of the vote, are discussed. Cooley plans toi review the prosecution of those convicted in the Rampart police misconduct scandal, to ease treatment of three-strikes felons, and has threatened to prosecute school board members for secret meetings.
