Discovery; legal limits on interrogatories
Article Abstract:
The 1993 amendments to Federal Rule of Civil Procedure 33 limit written interrogatories to 25 "including all discrete subparts," but that wording, and local district courts' liberty to adopt their own numerical limits, fails to amount to perfect guidance. Trial lawyers might choose to return to basics, simple elegant interrogatories asking the questions for which they were intended, and lawyers who do so will not have to worry about limits.

Article Abstract:
The article discusses Federal Rule of Civil Procedure 26(a)(2)(B) and its discovery requirement for detailed expert reports and other discovery rules regarding expert evidence. Only expert witnesses who are retained or employees of a party who regularly gives expert testimony must provide such reports. Possible reasons for the limitations on the report requirement are discussed.

The need for an amendment to the Federal Civil Procedure Rules to cover electronic discovery is argued. Reasonable information of electronic documents should not constitute spoliation. Since the various economic documents are so easily produced, a privilege review can become so burdensome as to be economically indefensible.
