Discovery; views on video
Article Abstract:
Issues regarding the use of videotaped depositions are discussed. Federal Rule of Evidence 32(c) states a preference for video over stenographic depositions, but videotaped depositions are seldom concise and interesting. Attorneys who have chosen not to video depositions may be able to edit them to make them more interesting during trial.

Discovery; you're on un-candid camera
Article Abstract:
Issues regarding the legality of secret surveillance videos as a discovery technique are discussed. Courts disagree on whether such videos can be kept secret while still meeting discovery obligations. Attorneys should be sure to request such material in discovery if theree is any chance one of their witnesses could be the legitimate subject of a surveillance. The videos are, with rare exceptions, work product.

Article Abstract:
Issues regarding the deposition of an opposing counsel are discussed. Shelton v. American Motors Corp. is the leading authority on this issue and states that the information to be gained must be relevant, not privileged, critical to the discovering party's trial preparation, and not discoverable by any other means.
