Divorce - mediation style: engaging in rational discussion is more civilized than courtroom sparring, but how lawyers fit in is an open question
Article Abstract:
Mediation of divorces, both voluntary and court-ordered, has become increasingly popular as an alternative to adversarial proceedings, but the proper role of attorneys and judges in mediation is unresolved. Mediation is less expensive than litigation and offers the parties the opportunity to work together. In many states, including states that mandate some mediation, there are few professional standards to be met by mediators. There is some question whether mediators that are not attorneys have the capacity to resolve the complex legal questions that arise in family law.

Richard E. Roy founded the Northwest Earth Institute, which funnels information to environmentally minded study groups.
