Drawing adverse inferences from the non-production of evidence
Article Abstract:
Arbitrators rely on adverse inferences in the absence of a general power to compel parties to produce evidence. Adverse inferences, therefore, not only facilitate appropriate disclosure but also enable parties to prevail on their claims and establish a moral conviction of the truth of an allegation.
