E-commerce; transferable records
Article Abstract:
Issues regarding the Electronic Signatures in Global and National Commerce Act and the Uniform Electronic Transactions Act are discussed. The core provisions of both laws state the contracts or signatures cannot be denied enforcement merely because they are executed in electronic form. Both laws recognize the transferable record as a new category of contract and an electronic equivalent of negotiability.

Whether customer databased should be protected by a privacy policy in Internet company bankruptcies is discussed. The Privacy Policy Enforcement in Bankruptcy Act of 2000 was enacted to prevent the sale of personal information in bankruptcy. The classification as a contract of the privacy policy between visitor and Web site operator is also discussed.
