Left speechless; out of court, defense lawyers feel a chilling breeze

Former John Gotti defense attorney Bruce Cutler is the latest in a series of attorneys found guilty of criminal contempt for talking to the media during trials. This began with Gentile v State Bar of Nevada, in which the Supreme Court ruled in favor of lawyer discipline for this offense. An ABA Criminal Justice Section committee is considering revisions of Model Rule 3.6 on extrajudicial statements, with proposals ranging from a stricter to a more lenient rule.

Article Abstract:
Prosecutors complain that the 1994 federal crime bill gives disproportionately more funding to police than to them and say there will be no way to deal with the increased arrests more police will make unless they get more funding. Observers say public pressure has hindered carefully thought-out planning. While it is difficult to compare prosecutorial spending patterns, the budget crunch in large cities such as Chicago, New York and Los Angeles is evident.
