Estate lawyers mount bicoastal battle; double-dipping statute defeated in New York, but not California
Article Abstract:
New York and California have introduced bills to limit attorneys' ability to represent a decedent's estate and at the same time act as executor of that person's will. Supporters of the law cite unnoticed abuses by some estate lawyers. The California bill seeks to ban double-dipping entirely, while the New York one aims to make the practice less profitable. Opponents who favor the spirit of the bills feel that the state supreme court rather than the legislature should define unethical conduct.
