Federal evidence; looking at vital rules
Article Abstract:
The U.S. Court of Appeals for the 11th Circuit ruled in U.S. v. Lowery held that 18 U.S.C. 201(c)(2) prohibited the plea agreement in question, in which the defendant was told the government would recommend a lighter sentence in return for testimony. A Florida legal ethics rule also prohibited the agreement. Arrangements in whichh prosecutors offer lighter sentences in return for testimony have been controversial.The McDade Amendment (28 USC 530(b), also provided that federal attorneys were subject to state law.

Article Abstract:
The most important of the Judicial Conference Advisory Committee on Evidence Rules is an amendment to Federal Rule of Evidence 702, the basic rule on expert evidence. This rule has been much considered because of the Supreme Court's 1993 ruling in Daubert v. Merrell Dow Pharmaceuticals, Inc., which gave judges the power to exclude unreliable expert testimony. The proposed amendment strengthens the Daubert principles and clarifies some of its ambiguities.

Article Abstract:
The period for public comment to proposed Federal Evidence rules 104, 404(a), 803(6) and 902 ends Feb 1, 1999, and if these rules proceed successfully through every stage of the rulemaking process, they will become law on Dec 1, 2000. These changes cover such matters as how to preserve a claim of evidentiary error for appeal, evidence going to prove a person's character, and the rule for the business records hearsay exception.
