High court to decide when RICO accrues; decision should resolve three-way circuit court split
Article Abstract:
The US Supreme Court is to rule in Grimmett v. Brown on which statute-of-limitations theory applies in civil RICO actions, the injury-discovery rule, the injury-and-pattern discovery rule, or the last-predicate-act rule. Different circuits have followed different rules and the Supreme Court will seek to resolve these differences. In addition to deciding when a civil RICO claim accrues, the court will rule on the narrower issue of whether the limitation period should be tolled until the end of the bankruptcy action when the alleged RICO fraud takes place in a bankruptcy, the theory being that no actual injury takes place until the debts are discharged.

The Gruter Institute for Law and Behavioral Research, founded in 1981 by Margaret Gruter, promotes the use of sociobiological concepts in the field of law. The members of this Calif think tank believe legal concepts such as the undue influence doctrine, as well as societal problems such as stepfather child abuse and the glass ceiling confronting women lawyers, have a biological basis. The Institute's annual seminars focus on the connections between legal theories, genetics, human evolution, and biological traits. For example, the glass ceiling may be partly due to evolution-based gender differences regarding aggressive behavior.
