Hints to foreign inventors: you can protect your invention date
Article Abstract:
It is possible for foreign inventors to establish legal protection in the US for the dates of their inventions. Section 104 of the Patent Code is generally interpreted to prevent such establishment, but it makes exceptions for inherency and derivation. Also, courts have accepted properly documented activities abroad as proof of date, such as reports, notebooks or data. Date protection can be used for affirming priority or antedating Rule 131 affidavit references.
