Hiring temps not always a bargain; states begin to crack down on abuses in the system
Article Abstract:
State regulators and courts want to ferret out abuses in corporation efforts to avoid benefit costs and lessen workers' compensation claims by using temporary employees. Pennsylvania and other state court decisions state that a contract making the temporary company the employer responsible for holding workers' compensation insurance and including an indemnification clause will not provide total legal immunity to the borrowing company. Making the temporary company contractually liable for workers' compensation actions could make the borrowing company the likely defendant in suits for workplace injuries.

Two federal antitrust cases regarding hospital mergers in mid-size communities have resulted in judgments against the government, raising questions about its tactics, arguments, and assumptions. Those backing the mergers say many hospitals have empty beds and must merge to keep costs down. Opponents say these mergers lead to monopolies and higher prices. Often the key question is how to define a hospital's geographic reach, a question whose answer is changing due to the pressures of health maintenance organizations.
