Jurisdiction of the International Criminal Tribunal for the Former Yugoslavia
Article Abstract:
The 1995 Dusko Tadic decision by the Appeals Chamber of the international tribunal for the former Yugoslavia held the tribunal has subject matter jurisdiction and crimes committed during noninternational armed conflicts are to be considered international crimes. The Appeals Chamber suggested each prosecution will require a determination as to the nature of the conflict in which the violations took place, which may be interpreted as recommending these conflicts be viewed as noninternational ones.

Article Abstract:
The author discusses two cases involving crimes against humanity under French law, In re Javor and In re Munyeshyaka. In the first case, the Cour de cassation found that there was no universal jurisdiction under the law to deal with Serbian war crimes charges; in the second case, the court ruled that it lacked jurisdiction over a case involving charges of war crimes in Rwanda.
