In new UCC software contracts, is the customer always wrong?
Article Abstract:
The drafting committee of the Uniform Commercial Code (UCC) is expanding Art. 2B to cover software contracts, and the latest draft is available on the official World Wide Web site of the National Conference of Commissioners on Uniform State Laws. One problem is that consumers or software licensees have little opportunity to read disclaimers or warranties before purchase. Consumer advocates urge that companies be required to post warnings about bugs on the Web sites and to affirm that reasonable efforts at repair were made before software release.

Communication in the e-mail era: deciphering the risks and fears
Article Abstract:
The applicability of traditional attorney-client privilege to e-mail transmissions is unclear. Laws vary among the states as to whether attorney-client transmissions must be encrypted. Concerned attorneys or their clients should remember that third-party access does not impair privilege, total client security may be impossible, and established case law may not be applicable to e-mail transmissions.

Article Abstract:
Law firms must develop rules on electronic records as its use increases. Some law firms simply delete electronic mail right away to avoid discovery requests. The other option in retaining electronic mail indenfinitely. The proliferation of encrypted electronic mail complicates matters. Some firms use encrypted mail for sensitive communications. Case law is developing.
