In sickness and in health, in Hawaii and where else?: conflict of laws and recognition of same-sex marriages
Article Abstract:
The rule of lex celebrationis and analogy to the freedom of contracting parties in the corporate context suggest that states should respect same-sex marriages entered into in other states. Conflicts of law doctrines stress the interest of comity and mutual recognition, and no public policy argument is strong enough to overcome recognition of same-sex marriages entered into in other states. Lex celebrationis, the doctrine that marriages respected in the place of celebration be respected elsewhere, should be upheld.
