In vitro fertilization: insurance and consumer protection
Article Abstract:
State consumer protection laws should be revised to allow health insurance consumers with adequate information regarding human reproductive technology coverage. The costs incurred by in vitro fertilization and other infertility treatments can be substantial, creating a tension between the need to provide coverage and economic considerations. Requiring availability of such coverage and disclosing that availability would allow consumers to make the difficult economic decisions implicated by insuring such treatments.

Second best: the soft underbelly of deterrence theory in tort
Article Abstract:
The use of tort law to deter marketing of unsafe products and services is unlikely to result in improved product safety and health. Optimal deterrence cannot be achieved because liability cannot cover all consumer choices or account for all factors related to health and safety. According to the theory of second best, when optimality cannot be achieved, correction of some flaws does not necessarily result in overall improvement.

The author is critical of the Connecticut Supreme Court's 1999 decision in Burke v. Fleet National Bank where the court held that the Connecticut Banking Commissioner misinterpreted a state statute when using it to support a prohibition on ATM surcharges.
