Article Abstract:
The US Supreme Court decision of Korematsu v. United States, which declared the removal of Japanese-Americans constitutional is often cited as important, albeit wrong, constitutional jursidprudence.? Plaintiff due process rights in assertions of personal jurisdiction
Article Abstract:
In deciding on personal jurisdiction matters, courts only consider the defendants' right to be free from the overreaching of the jurisdiction. However, plaintiffs have property rights in their causes of action which should also be considered. Personal jurisdiction decisions should thus take into account due process considerations for the plaintiff as well as the defendant.
