Innovation - or just court triage? California's justices are trying very hard to clear the docket
Article Abstract:
Critics are charging the California Supreme Court with too much emphasis in its procedural innovations on clearing the dockets expeditiously and too little on seeing that justice is done. These innovations include rent-a-judging, decertification, stipulated reversals and arbitrations approved despite the fact that they are unjust. Decertified opinions cannot be cited as precedent or published. Critics of stipulated reversals charge that they smack of collusion.

The court of St. Joan
Article Abstract:
Judge Jacqueline St. Joan presides over Department 303W of the Denver Municipal Court which is called the Protective Order Court. It issues restraining orders in cases of abused women and has become a court of last resort for those unable to pay court costs and attorney fees. Criticism of the court has been brought by the American Civil Liberties Union which claims that the courts actions amount to prearraignment punishment.

Article Abstract:
A Montana Supreme Court decision outlawing as a conflict of interest for the lawyers and as the misdemeanor practice of law by nonlawyers an insurance company's an insurance company's retaining lawyers to work for it exclusively on the defending of policyholders who have been sued is discussed. Having them supervised by claims adjusters using billing guidelines from headquarters constitutes the unauthorized practice of law.
