Article Abstract:
Hughes Aircraft Co's patent claim for a rocket-blast device invented in the late 1950s to stabilize communications satellites was first filed in 1973. The Supreme Court in Apr 1999 ordered the US Court of Appeals for the Federal Circuit to reconsider the case under the patent law's doctrine of equivalents. Many lawyers who have been involved with the case believe the 1983 Federal Circuit opinion finding infringement may be salvageable. That decision compared the patent as a whole with the government's infringing device.
