Labor law; NLRB battles the courts
Article Abstract:
Judicial review of NLRB cases regarding the employee-supervisor distinction is discussed. The split in opinion between the board and the courts regarding determinations of supervisory status shows no signs of changing, and tips for the various parties on dealing with the agency's scrutiny are given.

Issues are discussed regarding the increased scrutiny over employer monitoring of employee e-mail signaled by NLRB decisions.The decisions apply to union and nonunion employees alike, and employers should consider them when drafting and enforcing workplace communications policies. Pratt & Whitney, issued by the NLRB's Division of Advice, is discussed at some length.
