Labor relations in the Dept. of Homeland Security: competing perspectives and future possibilities
Article Abstract:
Several competing visions of the Department of Homeland Security's labor relations envisioned everything from the complete exclusion of unions for the Department's employees to full union rights. The Homeland Security Act of 2002 allows unions to exist in the Department, but with some discretion by the Secreatary or President to deny union coverage to some employees. The most efficacious way of organizing labor relations in the DHS would be for labor and management to cooperate in a formal body to help shape the new Department's labor policy.

Bargaining over the terms and conditions for striker replacements: is the NLRB about to change the rules?
Article Abstract:
The 1995 National Labor Relations Board went against Board precedent in ruling that the Chicago Tribune violated the National Labor Relations Act when it made a new wage scale for non-striking employees. Though not in the ruling, the decision included a footnote stating that strike replacement workers were also protected by the union. This goes directly against the position established by the Board and courts after NLRB v. Katz, which states that to have the union represent both striking and replacement workers is a conflict of interest.

Labor law has been responding to the lessened strength of unions and the introduction of unions into pink- and white-collar sectors in a fragmented fashion despite the reasons for the decisions having similar foundations. Court decisions concerning the transfer of a union-contracted business to a new owner; significant expansion of a unionized company; and the creation of a parallel, non-union business share a focus on burden of proof, employee free choice and union and company motivation in making and contesting the change.
