Lawyers, agency spar over Vietnam records
Article Abstract:
Sole practitioner John C Mattes is suing in the US Court of Claims for breach of contract regarding nearly 300 S Vietnamese commandos for whom he is seeking back pay. He contends the US employed the commandos, who were recruited by the S Vietnamese military, from 1961 to 1969 to disrupt N Vietnam's economy and transportation. The govt has replied that his complaint is too vague, but he insists the Pentagon houses 53 boxes of detailed records giving names and amounts documenting the US's role.

Holocaust claims get a new boost; several lawsuits and creation of an international tribunal may speed insurers' response to claimants
Article Abstract:
Political pressure by Holocaust survivor groups, lawyers and regulators may have ended decades of denials by European insurance companies and forced them into steps toward resolving the claims of the families largely wiped out in the Nazi death camps. Allianz, Assuricazioni Generali, AXA Group and Zurich Insurance Group agreed in Apr 1998 to show their books to the international claims commission. An aid fund for indigent survivors is also in the planning.

Cali ruling lifts Warsaw damage limit: willful misconduct found question of law, not fact
Article Abstract:
A federal court has recently ruled that judge, as opposed to jury, can make a finding of willful misconduct in a crash. The consequence of the ruling is to allow families of survivors to seek compensatory damages in excess of the $75,000 limit previously adhered to pursuant to the Warsaw Convention. The 1996 crash of an American Airlines jet near Cali, Columbia was the subject of the ruling.
