Lying federal prosecutor is immune; hands tied, the 1st Circuit refers the case to state and federal ethics panels
Article Abstract:
The US Court of Appeals for the 1st Circuit upheld the dismissal in Aversa v. United States of a libel suit against an IRS investigator and assistant US attorney for an accusal of a tax reporting violation and an implication of illicit earning of money when the public officials knew the accusations were incorrect. The court agreed that the suit could not take place because the public officials enjoyed government immunity from civil actions, were acting within the scope of their employment and that the law allowing suits against the federal government excludes defamation actions.

Prosecutors nationwide fear the Sept 25 murder of assistant Massachusetts attorney general Paul R. McLaughlin may herald a more brutal and threatening era with fewer rules. McLaughlin, 42, was Boston's top prosecutor of gang crime; the killer is thought to be a young black man. Four state prosecutors have been murdered in the US since 1980 because of their work, but threats against federal prosecutors have declined from 500 in FY 1990 to 173 in FY 1995. The US Virgin Islands are reputed to be among the most dangerous places for prosecutors.

A capital defender; the former Justice Department prosecutor scores the unchecked powers of independent counsel
Article Abstract:
Reid H. Weingarten had 10 years of experience with the Public Integrity Section of the Justice Department and then moved on to the capital's Steptoe and Johnson, where he defends those accused of political crimes. The Public Integrity Section was established after Watergate and doubled during Weingarten's tenure. The section was well-respected and appeared throughout the country against locally powerful politicians. At Steptoe 9 attorneys spend all their time on criminal defense and when Weingarten joined, only one did such work.
