Judge hits feds in fraud appeal: doubts over prosecution theory result in bail for a former Cavath associate and others in Florida case
Article Abstract:
Three federal judges on Mar 9, 1995, raised serious questions about the prosecution's case in the 1993 convictions of four FL executives on fraud charges. Robert Ehrling, Tore DeBella, David Brown, and Richard Reizen have each served two years of five- to ten-year sentences. The judges said the govt appeared to have no foundation for its case against the former executives of General Development Corp, once one of FL's largest home-development companies. The firm said it had acted on the advice of Cravath, Swaine & Moore of NY.

Court clears the GDC executives; the 11th Circuit dismisses real estate fraud cases
Article Abstract:
Four former executives of Miami's General Development Corp had their fraud convictions reversed and cases dismissed by the US Court of Appeals for the 11th Circuit. The corporation had been charged with committing one of Florida's largest real estate scams by deliberately defrauding thousands of real estate investors, but the federal court questioned whether a crime had been committed and felt the investors had resources at their disposal to determine if the home prices were inflated.

US District Judge William M. Hoeveler on Sep 12, 1995, threw out two guilty verdicts against attorney Kenneth Treadwell and restored the immunity he had enjoyed as a government witness. Asst US Atty Lohar Grenge claimed Treadwell misled prosecutors concerning events at Sunrise Savings & Loan of Boynton Beach, FL, where he was general counsel. Only on his third effort to indict Treadwell did Grenge succeed, but Hoeveler said the government's evidence was weak.
