Major changes to patent rules

The final changes to the Rules of Patent Practice were published in the Federal Register on Oct 10, 1997 in 'Changes to Patent Practice and Procedure.' Significant time and cost saving changes, which will reduce applicant burden, have been made after public notice and comment. Areas of change include application filing, deceptive intent, appeals, and time periods.

The author analyzes the question of whether the US Patent and Trademark Office may issue patents to developers of new varieties of sexually reproduced plants. The history of law protecting sexually reproduced plant varieties is provided, along with applicable US and European Union law.
