Metanoia and the rule of law in the single market
Article Abstract:
The Commission has made a strong stand on enforcement issues to ensure that businesses benefit from operating in the single market. However there is doubt about the effectiveness of many EU rules, and many member states are disregarding them. There are also doubts over the effectiveness of enforcement procedures and the role of the national courts. Member states must create a powerful single market enforcement court in Brussels to ensure that EU rules are effectively applied and they need to understand that the rule of law is not optional.

The ECJ: a court with a mission?
Article Abstract:
The European Court of Justice (ECJ) has been criticised by lawyer Patrick Neil, who has told the UK's House of Lords that it has political objectives which could become out of control. Additional complaints have been submitted by Britain to the intergovernmental conference, with proposals on reform. Criticism of the ECJ by the UK is seen as surprising since it applies the Court's rulings precisely.

Reforming product liability
Article Abstract:
The European Union is likely to reform its 1985 product liability directive because of increasing pressure for reform. Among the main features of the directive are producer liability, compensation limits and proof by victim. Possible future reform could include changes to the burden of proof and greater settlement transparency.
