The application of the patent guidelines' utility and written description requirements to biotechnology patents is discussed. Those issued in Jan 2001 focus on the patentability of genomic material, arguing for patents of isolated and purified DNA since it differs from the naturally occurring form.

The effect on the biotechnology industry of pending laws on genetic privacy and discrimination, as well as those on research and intellectual property in the area are discussed. Congress has failed to enact genetic privacy legislation despite wide public concern.
