Obtaining arbitral awards under the Inter-American Convention
Article Abstract:
The US Second Circuit Court of Appeals recently upheld a decision enforcing an award made under the Inter-American Convention for International Commercial Arbitration. The opinion in Productos Mercantiles e Industriales S.A. v Faberge USA, Inc. explicates the applicability of that Convention, as well as on the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, and clarifies the procedures for enforcing an arbitral award against a party that did not participate directly in the original arbitration.

Back pay awards: current arbitral patterns
Article Abstract:
A survey of 298 back pay awards revealed how judges calculate back pay. In most cases, specific directions were not needed because determining the amount was straightforward. Other cases involved adjustments for unemployment compensation and interim earnings. Interest on back pay was rarely awarded.
