On the issue of support and enablement for claimed limitations as given by drawings
Article Abstract:
A patent examiner evaluating a drawing, submitted as sole support of a claimed limitation in a patent application, relies on existing statutory and case law guidelines regarding support and enablement in order to analyze the disclosed limitation. The examiner must consider the degree of refinement in the state of the art to determine whether or not the drawing actually supports the mathematical expression that it represents. The examiner's task is difficult if the drawing is the sole support for an object whose shape is expressed in purely mathematical terms, especially when the drawing contains possible ambiguities.
