Patent law; examination guidelines
Article Abstract:
Issues regarding the 1999 provisional guidelines for examination of patent applications are discussed. These guidelines use the Federal Circuit's test for written-description compliance, and also require that the examiner determine the "essential distinguishing characteristics" of the invention and that applicants itdentify a specific utility to their invention.
