Copyright law; visual artists' rights
Article Abstract:
Issues regarding the Visual Artists Rights Act of 1990 (VARA) and some practical pointers regarding that federal law are discussed. Patent pools, cross licenses draw antitrust scrutiny; DOJ, however, is demonstrating consistency in its approach and flexibility in two review letters
Article Abstract:
The Department of Justice's Antitrust Div. has devoted more attention to cross-licensing and patent pooling, even though the department believes that most of these practices are pro-competitive. Cross licenses between firms that are competitors are more likely to produce the anticompetitive consequences, and can include price increases, production cutbacks and reduced innovation. Federal antitrust enforcement agencies using a "rule of reason" test to analyze these patent arrangements look closely to how they affect innovation.
