Patents and antitrust: a rethinking in light of patent breadth and sequential innovation
Article Abstract:
Strong patent laws protect the interests of inventors, but patent protections must be balanced with antitrust protections to effectively promote innovations by subsequent inventors. Patent laws are assumed to promote invention by ensuring that inventors have adequate incentives to invest in research, but the efforts of subsequent researchers can be thwarted by the broad interpretation of patent protections. Two areas that might require antitrust law scrutiny are pooled research resulting in patents and cross-licensing of patents.
