Plan administrator held not liable for delay in distribution of s. 401(k) account
Article Abstract:
The U.S. 8th Circuit Court of Appeals in Kerr v. Vatterott held that a 401(k) plan administrator did not breach his fiduciary duties by delaying distribution of a participant's balance for over 3 years. The holding was reluctantly based upon ERISA provisions and their U.S. Supreme Court interpretation.
