Protection of business investments in human capital: shop right and related doctrines
Article Abstract:
Equitable and contract doctrines including the shop right rule further the constitutional goal of encouraging new technologies by rewarding investment in research and development. Federal law requires patent applications to be in the name of inventors whose intellects but not necessarily financial resources contribute to their inventions. Courts uphold actual assignments and support doctrines implying assignments of rights when disagreements between the parties, who are often employer and employee, arise.
