Provisional and protective measures under Austrian Arbitration Law

The article examines the drastic changes based on the Model Law made in the Austrian Code of Civil Procedure (CCP) by investigating the arbitrator's power to grant provisional measures and the court's role in the interim protection of rights under the Austrian Arbitration Law.

'First experiences' with the new Austrian Arbitration Law: a German perspective
Article Abstract:
The article examines how Austrian courts will apply the new Austrian Arbitration Law in selected areas on the basis of the German perspective of its existing jurisprudence. It is suggested that the similarity between both laws will mutually influence their development.
