Recent tobacco rulings give both sides the jitters: the anti-tobacco effort has suffered setbacks in West Virginia and Florida, but has advanced in Minnesota
Article Abstract:
Several key cases are being tried in the argument that tobacco companies should be held liable for smokers' medical care costs and both sides of this issue have had victories. A victory for the tobacco industry was had in the West Virginia state case when eight of the ten charges were dismissed because the attorney general lacked standing. However, Mississippi narrowly avoided an attempt to dismiss a case against tobacco companies while a Florida case found that incriminating Brown and Williamson documents should be left available to the public.

Tobacco: and now the appeal; industry may suffer more because it's the 4th Circuit
Article Abstract:
A federal trial court ruling in Coyne Beah, Inc. v. FDA that the agency has almost unlimited power to regulate the tobacco industry will face the US 4th District Court of Appeal. Industry lawyers thinking of using First Amendment arguments cannot forget that the circuit has recently upheld freedom of speech bans in another case. A global settlement of lawsuits filed by 24 state attorneys general is a possibility. The industry may give up tobacco advertising to children in such talks as such advertising is hard to defend politically.

Tobacco nightmare; Michael Ciresi heads trial team pushing for Big Tobacco's worst loss
Article Abstract:
Michael V. Ciresi has charge of the trial team suing the tobacco industry for the medical costs Minnesota and Blue Cross/Blue Shield claim to have spent to treat smoking-related illnesses. Minnesota, Blue Cross and Ciresi's firm, Robins Kaplan, have been on their own in the fight against the tobacco industry almost from the beginning. They were early critics of negotiations which led in mid-1997 to the proposed $368.5 global resolution of tobacco industry liability.
