Same ills, different solutions; tale of two cities
Article Abstract:
Globe, AZ, is white and Texarkana, TX, African American. They were both faced with toxic tort situations, but received very different levels of federal government help in their attempts to solve them. The soil under the trailer park in Globe, AZ, is 60% asbestos. After a two-year legal battle, residents were awarded $80,000 to help in their moves away from the area. Various toxic chemicals were used for wood preservation in the area of Carver Terrace in Texarkana, TX. Residents fought for 20 years and received only $30,000-$40,000 each for their homes.

Seeking clarity on fines for polluting agencies
Article Abstract:
The sovereign immunity doctrine shields federal agencies from pollution liability when sued by states. The Supreme Court issued this opinion in US Department of Energy v Ohio, the case regarding the federal uranium plant in Fernald, OH. Thirty states which signed an amicus brief for Ohio are seeking help from Congress, where a bill is being considered that would subject the federal government to punitive damages.
