Statisticians at DOJ may overstate case; government't use of statistical sampling to prove False Claims Act liability, damages may be unreliable, if not impermissible
Article Abstract:
The evidence required for the government to prove False Claims Act liability is a claim which the health care provider knew was fraudulent presented for government reimbursement, and the government statistician uses random statistical sampling to prove damages and liability in many large cases, reviewing only a small portion of a health care provider's claims. Health care providers object to this method, saying that it dramatically increases the damages calculation and improperly encourages quick settlements.
