Supermandamus; stiffer standard for attorney disqualification
Article Abstract:
The 7th Circuit in Joel E. Sandahl and Complex Systems, Inc issued a writ of mandamus overturning a law firm's disqualification. The court held that the 'clear right to relief' standard for granting a writ of mandamus had been met. Chicago's Mayer, Brown and Platt was disqualified from representing a defendant business right after terminating its relationship with the buyer of the business which brought the suit. The 7th Circuit disagreed with the trial court's finding of client abandonment since the termination was consensual and ruled that Mayer was not benefiting from the conflict created.
