Some of the arguments of the fans of dictaphones remaining are discussed. Included are dictating being faster than typing and that talking through an argument sharpens lawyers' ability to think and talk on their feet. Voice recognition software is also discussed.

Staking out a detective

The use of private investigators by lawyers in trial practice is discussed. Risks include having the client represented by the opposing side sue for invasion of privacy when the investigator goes beyond the bounds of appropriate behavior.

Changing shifts

Flexibility is the theme of new working arrangements, and these include telecommuting, flexible work hours, part time employment, job sharing and independent contracting. The law has had to struggle to keep up with all these changes, and questions include who in entitled to benefits, what constitutes a workplace and how the employer-employee relationship is defined. Flextime issues have made an appearance in various employee lawsuits.
